In October 2025, the American Bar Association’s Standing Committee on Ethics and Professional Responsibility issued ABA Formal Opinion 518 entitled “"A Lawyer's Duties to Avoid Misleading Communications When Acting as a Third-Party Neutral Mediator". The Rule opines that lawyers who act as mediators must adhere to rules of honesty and role transparency, explicitly avoiding the deceptive "puffery" allowed for advocates and instead adhering strictly to a standard of truthfulness required of a neutral.
